Doesn't this just make open source really hard to use in the EU? Even if the politicians draw a perfect line between commercial and non commercial activity then companies that want to use open source probably won't because the open source software doesn't come with the necessary paperwork. Inevitably they'll just buy from companies selling complying software instead.
